Social Security Disability benefits are part of a government-sponsored insurance program. Eligibility for Social Security Disability benefits is based on the individual’s earnings history. An individual must be disabled for six months prior to filing for Social Security Disability benefits. It is not necessary to prove that the disability is related to occupational disease or injury in order to qualify. Because of the need for treatment and the poor prognosis, mesothelioma victims are generally qualified to receive Social Security Disability benefits as long as they have an adequate earnings history. It is permissible to pursue a third party lawsuit and to receive workers’ compensation insurance benefits and Social Security Disability benefits all at the same time.
